Welcome to Bhojezy! By accessing or using our food ordering app, which offers dine-in, takeaway, and delivery options, you agree to comply with and be bound by these Terms and Conditions.

About Us

Bhojezy is a platform developed by VRBIZTEC PRIVATE LIMITED that connects customers with various food outlets to order food for dine-in, takeaway, or delivery and also provides a food outlet management system to food outlets.

These terms & conditions (“Terms and Conditions”) apply to the website, and all of its divisions, subsidiaries, and affiliate operated Internet sites, which reference these Terms and Conditions. This website is owned and operated by BHOJEZY. For the purposes of this website, “BHOJEZY “we”, “us” and “our” all refer the “BHOJEZY” We, BHOJEZY, a company registered in India and operating within the ambit of the laws of Indian country, and having our registered office at Hno.1-1-27/9, Ashok Manoj Nagar, Kapra, Hyderabad, Telangana,India-500062

Compliance with Regulations

All participating food outlets must comply with the Food Safety and Standards Authority of India (FSSAI) regulations concerning food safety, hygiene, and shelf life. Outlets found in violation of these regulations may be subject to penalties or removal from our platform.

Commission and Fees

Outlets are charged a commission fee on the final order amount after taxes. This fee is specified in our partnership agreements and is calculated as a percentage of the total sales conducted through our platform. In addition to the commission, outlets are responsible for any statutory deductions and payment gateway charges.

Ordering and Payments

Customers can select from a variety of food outlets and place orders through the app. All payments are to be made through the app using the provided payment methods, which are subject to additional charges as applicable. Customers recharging their wallet in the app will be deducted payment gateway charges as per the PSP and the balance amount after deduction of charges will be credited to the customer wallet inside the app.

Cancellation and Refunds

Customers are entitled to a full refund if an order is canceled within one minute after placing it or if the restaurant rejects the order due to any reason.

A full refund may also be issued if the food received from the restaurant is deemed unsatisfactory, with Bhojezy making the final decision on the matter.

For cancellations made under other circumstances, refunds will be at the discretion of Bhojezy and may be partial or denied.

All refund amounts shall be credited to the customer wallet by default. If they wish to get the refund credited to the source used by them to make the payment to place the order.It is estimated to take 5-7 business days to process the refund for all payment methods namely netbanking,credit/debit card,wallets,UPI,Sodexo.

Delivery

Delivery services may be provided by third-party partners or by the restaurants themselves if they possess their own delivery fleet.

Bhojezy is not responsible for the delivery times or the condition of the food upon delivery for orders fulfilled by restaurants with their own delivery services.

For third-party deliveries, Bhojezy will endeavor to monitor delivery quality but does not guarantee the performance of third-party delivery services.

Limitation of Liability

Bhojezy shall not be liable for any damages arising from the use of the app, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnity

You agree to indemnify and hold harmless Bhojezy and its affiliates from any claims, losses, damages, or liabilities incurred due to your use of the app, violation of these Terms, or violation of any third-party rights.

User content

This website may enable you to create, modify, transmit, upload, download, purchase or submit images and other materials and information (together, 'user content'). By creating, modifying, transmitting, uploading, or submitting any user content ('your user content'), you:

Grant us a non-exclusive, royalty-free, fully paid-up, worldwide, perpetual, irrevocable, license to (i) use, copy, modify, distribute, transmit, broadcast, create derivative works of, publicly display and publicly perform your user content (by all means and in any media now known or hereafter developed); (ii) license, sell, rent, lease, or lend copies of your user content (and derivative works thereof); (iii) sublicense to third parties any or all of the aforementioned rights (including the right to sublicense to further third parties); (iv) use and publish your name and alias in connection with your user content as well as in connection with all advertising, marketing and promotional material that we may publish in relation to your user content;

Acknowledge and agree that no royalties or other compensation will be paid or payable to you for your user content, or for the granting of the rights described above.

Feedback and unsolicited ideas:

If you give us feedback about this website or services, you grant us the right to use that feedback for the purpose of improving our App, products or services (and for any other purpose we deem necessary or desirable) without being obliged to pay you any compensation in respect of our use of that feedback. We (and our employees and agents) do not accept or consider unsolicited ideas, including artwork, demos, samples, and other ideas for new promotions, products, product names, processes, technologies, or materials ('unsolicited ideas'). You must not send unsolicited ideas to us. If you do send us unsolicited ideas:

we do not warrant or represent that those unsolicited ideas will be treated as confidential or proprietary; and such unsolicited ideas will be treated and licensed as if they were 'user content' in accordance with these Terms.

Interactions between users

You are solely responsible for your interactions with other users of this web App or any of our services. We reserve the right, but have no obligation, to monitor interactions, discussions, or disputes between you and other users.

Your warranties comply with all of the warranties and representations described below. You warrant and represent that:

you own or otherwise have all rights necessary for you to create, modify, transmit, upload, or submit your user content and grant the rights described in above; where copyright (or any other intellectual property right) in any part of your user

content does not belong to you, the owner of that part has granted you permission to use that part in accordance with the permitted functionality of this websites and to license that part in accordance with clause 11;

your user content does not contain any viruses, worms, spyware, or other components or instructions that are malicious, deceptive, or designed to limit or harm the functionality of a computer;

your user content does not contain or comprise material that is unlawful, objectionable, defamatory, threatening, pornographic, harassing, hateful, racially or ethnically offensive; encourages conduct that would be considered a criminal offence, give rise to civil liability, violate any law; contains any falsehood or misrepresentation that could damage us or any third party; or is otherwise inappropriate; and You must not create, modify, transmit, upload, or submit any user content that does not relevant to the Application.

Changes to Terms

Bhojezy reserves the right to modify these Terms at any time.

Governing Law

These Terms are governed by the laws of Hyderabad,Telangana,India without regard to its conflict of law provisions.
